Health & Safety on School Premises

Yesterday our daughter fell into potholes, immediately outside her school's reception area, on school premises. She sustained a split knee, cuts & abrasions, suspected fractured ankle, a shadow shown on the bone @ X-ray and was shocked & upset. She cannot walk & has to await the swelling of the limb to reduce before plastering can be considered.
Can anyone supply a brief synopsis of the school's responsibilities, relevant legislation or even liability.
These potholes have existed for at least 3 years without any remedial work carried out.
We don't want to cause trouble, but the Head Teacher is an "avoider of issues" & we hate the idea of another student suffering similar.
Our daughter is 14.

If they've been there for 3 years, then surely she woould have been aware of them?

Accidents happen and not everything is worth a claim.

I know you say you don't want to cause trouble but if you do wish to take it further you can contact the HSE under RIDDOR 1995.

anyway, i would ahve thought you could at least meet with the head and ask for the holes to be fixed after what has happened. Perhaps if you even hinted you might want compensation (even if you don't) it might get their finger out

if she had an accident that resulted in her going to hopsital the school has to file with riddor

there should be a risk assessment in place - which you can ask to see (bet they've not done one) as its dangerous there should be at teh very least warning signs etc etc

I would suggest you write to the Head of Governors with a copy to the headteacher. Inform the Governors what has happenned and ask them to investigate and request feedback on how to avoid any future accidents. One of the Governors will have almost certainly been charged with the responsability of reviewing the Health and safety policy at the school. I hope your daughtour recovers quickly
