I do not accept liability.. can i be forced to accept it without it being taken to court?

I overtook the middle lane of a 3 lane motorway, and pulled out into the 3rd lane to overtake it. at the point i checked my mirrors (while i was doing 70mph) a BMW was roughly 80-100 yards behind me...
