My son and daughter in law went to DFS to buy a sofa they signed a credit agreement and and another paper with DFS and went away happy however five days later their car needed a new clutch so they decided to cancel the sofa with DFS they were told that there was no cooling off period and that they would have to pay £200 cancelation fee although the wait for the sofa was 12 weeks is this right or is it compulsory to have a cooling off period. A friend of theirs said that she was told on purchasing a sofa from them that there was a ten day cooling off period. Can anyone advise ??

Cooling off periods for credit agreements only apply when they're signed away from the trader's normal place of business, which would not seem to apply in this situation.

Further (when purchasing from a store, rather than online) there is no cooling off period in respect of a contract to purchase (which is separate to the credit agreement). Even if DFS permitted the cancellation of the credit agreement, your son would still obliged to meet the separate contract for the purchase of the sofa. (i.e. DFS could insists that he paid cash or, only if they were agreeable, enter into a different credit agreement).

Chris
surely they're not paying anything for the sofa for the next 12 months anyway...
That depends on what was agreed sara. DFS offer 4 years interest free credit. You can take the first year off, or the first 4 years off and pay it all in the last month. You can also start paying straight away.

DFS tell you there is no cooling off period at the POS and that there will be an admin charge if you do so. DFS don't issue the loans - if you wish to cancel that you need to contact the loan company themselves Santander Cards UK 0871052205037

Also, if the sofa was custom built as in they chose the colour of fabric/leather or the colour of the feet/legs then DFS will tell you you cannot cancel the order. period as you have had it made to your specifications
That should say "there will be an admin charge if you do CANCEL"
This credit agreement must be covered in the consummer credit act which states you are entitled to cancel within a short period of time - normally anthing between 5-14 working days
All confusing views - I woluld agree with Chris in that you signed contract on sellers place of buisiness - so no pressure applied. What does the contract you signed say?
