It depends how he presents. However, the Mental Capacity Act makes it clear that capacity is to be presumed unless proved otherwise. If his capacity is questioned, there would have to be an assessment. Even then, that can be challenged in the Court of Protection.

I know now that I need to deal with my drinking. It's reassuring to know that if I look for help I won't categorised as a suitable case for a place in an old persons home.
