A directive has to be implemented by a certain date, and can be subject to manipulation and interpretation.

As to whether you can rely on these in court - yes in theory, particularly regs, but you'll want a decent lawyer.

Google "Citizens Signpost." You will find an official and authorative EU service which will answer questions on jurisdiction and applicability of laws, cross-border. I found them helpful and have recently successfully sued a French trader by relying on Distance Selling Regulations 2000. As to the status of Directives, I'm sure that the Citizens Signpost service would be able to define the distinction for you.
