common ass by beating (cont......) i'm the victim!!!
It got to 11pm (6hrs) & they finally said they werent coming & would come in the morning. I was very upset with how they dealt with me, especially as I was a victim. A single mother, scared!!! The next morning the Police knocked & I WAS ARRESTED! I was put in a cell for 9hrs, questioned & charged for COMMON ASS BY BEATING ON MY EX & HIS PARTNER? I apparently punched him once in face & kicked her knee! No injurys! I am obviously very ****** OFF!! This was 4 wks ago-I have already pleaded NOT GUILTY & the trial starts in Sept. I cant believe how the Police worked this out? I'm honest, hard working loving mother, with no previous or criminal record! My ex has been arrested when we were together for ass on me, he has been charged with theft before, has lost his licence twice through drink driving & thats just what I know of there could be more. Obviously I know the girlfriend is lying to stop him getting into trouble & the police obviously take their lies as there are TWO of them & ONE of me-how unfair!! Can anyone give me some advice on what to expect? My solictior is away so cant spk to him til he returns-but i'm nervous-just because I know i'm innocent doesnt mean anything! I never thought i'd get charged-i niavely thought. They can charge you with no evidence. THANK YOU X

I'm not sure what you're asking and I'm no expert in the law but I had an experience much like your's when an ex and her friend accused me of a similar offence with no evidence at all. It seems that you don't need evidence to be charged but from my experience, I believe they need some sort of independant witness statement or evidence to find you guilty.
Your best defence will be sticking to the truth and in future you should go down the correct channels if you think you are intitled to more child benefit payments and avoid contact with your ex. Make sure your solicitor is doing all he can and hopefully you'll avoid a conviction as I did.
There are some very knowledgable people giving advice on this site but beware of the people that will try to wind you up and upset you more than you already are. Take their comments with a pinch of salt and laugh with them!!

The magistrates will not be impressed with the prosecution if the "victims" did not get photos or medical report on their "injuries" any decent solicitor should be able to get to the truth where your ex and his partner are concerned. I would only be worried if there was an independant witness who saw you assault these people.If he has a record for assault on you your solicitor could make an application of bad charactor this tells the mags that he has been in trouble for assault on you..the only advice I can give you when you go to court is
1. Tell the truth
2. Dont get angry with questions
3. Think before you answer questions
4.DONT talk too much....answer the question then shut up even if the lawyer is looking at you expecting you to carry on talking.

Domestic violence cases need to go before a CPS lawyer to authorise a charge - pretty much everywhere. Now the CPS work on the premise that a convictley than not on the basis of thre evidence before them.
So, I suspect that there may be more evidence than is being let on here that the CPS.(or you for that matter) are aware of. I would suggest that your lawyer gets some disclosure and reconsider your plea as appropriate.
As regard medical evidence, not required for a common assault - in fact rarely available given the minor nature of the assault.
Medical evidence only required for S47/20/18 assaults.
