I think I remember that the loophole was closed on this but was interested to see whether people can still claim them back.

I thought this wasn't the case but have spoken to people who have since claimed them back successfully.

Does anyone know if they can still be claimed back?

Yes you can - there are some companies who will take the case on for you, too, although you have to pay them a fee. I'm trying it at the moment, the bank is demurring, wanting to wait until the judicial hearing, but we are pursuing it. The company says that where individuals pursue the claim, there's a possibility of leaving out vital information (well they would say that, wouldn't they) but they know all the terminology and who and where to pressure. I'm having to pay the company 20% of any money received, but IMO it's 20% of money I wouldn't have at all if the claim wasn't being made, so I don't resent it. You don't pay anything, either, until the refund is cleared and in your bank. I won't advertise by saying who it is, but thus far it's been worth it to me to use an intermediary.
I'm in the process of doing it now with credit cards. Martin Lewis has some good tips.

I did it years ago with bank charges and got £1,200 back. (I was terrible with money).
As a one off, the bank may refund a single charge if asked nicely.

Otherwise there is provision for those suffering severe financial hardship to claim charges back. Banks must consider such claims and it can result in (normally) partial refunds.
According to the unwanted calls I get every other day, yes. Never bothered to listen all the way through though.
