What was the item and why is it not working properly?
I am not sure if the Sales of Goods act works with second hand goods but if so then you should ask for the item back and refund the money. That way your repuatation stays in tact and in future you should cover yourself with something in the sales particulars that covers you should the item fail.
If you are a private citizen and sold your car through the papers and it went wrong a week after use, then it is 'buyer beware' and you have nothing to worry about.
If you let us know what you do for a living, what you sold, whether you sell these items regularly, how you sold it etc, we can perhaps help more.
If I buy something from a shop then if it breaks almost immediately after I get it home then it's assumed that the fault was inherent and the shop are to blame for selling me faulty goods. They're required to replace or refund.
In the former (but not the latter) if it's in perfect nick when sold but then, by some bad luck, breaks due to normal use soon after the sale then it's still "bad luck" for the buyer.
It's probably important that you advertised this as "I checked it yesterday and was working fine" as opposed to "I can guarantee it'll not break within 6 months" if it's a private sale.
thankyou to all of you who have put my mind at rest!if i would of sold a "duff article" i couldnt live with myself,it was in good working order when sold -i cant put too much detail here for obvious reasons-shame we cant e-mail each other cos then you could be told the full details :p = thanks again
