overpaid

was overpaid by �300 back in august last year and it was never queried by my employer until today i get a letter explaining it was there fault and they admitted they had made the error and would like it back. My question is, although it was never mine to start with and has now been spent do i have any entitlement to it? Thank you .

Mistake or not it was never your money. They are well within their rights to ask for it back, however they also have to accept any reasonable payment offer, you could offer to pay back �10 a month for 30 months.
Just depends on if you can afford it and whether you want it to drag on for a long time.

Sorry, but if you're not legally entitled to it, you will have to pay it back. But I think it's perfectly reasonably for you to ask to pay it back over a period of time, rather in one payment. If you suddenly spot a discrepancy in your pay packet in future, it's best to query it straight away rather than wait as it will only delay the agony of repayment.
I should say, this happened to me about a year ago. I left but apparently had an extra days holiday which I was paid for.
I had to pay back �120 or so, I tried to drag it out and they got really nasty saying they were passing it on to the county court, I paid of course but it's not worth getting a bad credit history over.
But as WendyS and I said a reasonably payment schedule is the way to go if you can't afford it all in one go.
