home buying
3 Answers
I am in the process of buying a house from the receivers before it goes back to the mortgage company. the offer has been accepted but the wife has put on matrimonial notice with the land registry even though her name was not on the mortgae. Her husband aged 50 ran off with one of his driving instructor pupils aged 17. Is it still worth buying?

This does not stop her from having a beneficial interest in the property. I'm not sure whether you (or anyone else, for that matter) could buy until the matrimonial notice is removed, but if you could and you did buy with it still on the title you would presumably be at risk of having to satisfy the notice by paying the wife whatever the Court eventually decides she should have from the property. I would certainly not go ahead without this all being sorted out, but you need advice from your solicitor.
