advice on leaving the UK urgent
12 Answers
I want to migrat to Australia very urgently, I have no major debts in the UK, i am on a morgage with my mother we are joint owners of a flat, unfortunatley shes very stubborn and wont agree to get my name removed from the deeds,
I have no other debts just a few small minor bills like car insurance and minor things like that which can be cancelled and paid off,
Can anyone advice me on what may happen if i leave without my mothers knowledge and the Interpol would they call me back and say 'you have to help pay the morgage'
ill be going to tasmania which is in australia
many thanx

They will just chase the easiest to chase - your mother. No one will chase you offshore (they could but they won't). HOWEVER,
1 - Companies like equifax and other credit agencies do check internationally (Europe and Usa at the moment for credit status and defaults - so if your mother defaults after yo have gone this would affect your credit rating.
2 - Entry into OZ may be conditional on your credit being of good standing - which it may be on entry - so don't do anything that may cause them to check again.
3 - there may be asset value in the house - are you sure you want to throw it away.
4 - If you want to get really shirty with your mum then move a tennent in while your away. Try one with bad hygene and loud music.

11:25 Hello there,
Can I just add a few thoughts to the excellent(above) answers.
Even if you can enter Tasmania having defaulted on a mortgage, have you considered just what you are leaving your Mother with? She(presumably) would not be able to pay the full mortgage, and if so the house would be reposessed and she would be on the street. The Police(Interpol or otherwise) would not get involved in this matter. As bizarreday says it would only affect your credit rating on entering Tasmania,I can't see how you think yours will be good, given that you have defaulted on the mortgage. If you do enter Tasmania with a good credit rating,as soon as the credit agencies there hear of the mortgage default, they MAY contact the immigration authorities and you would be deported!
BTW are you intending to work in Tasmania, and if so do you have a work visa? These are issued on a "one entry" basis, that is you can work for as long as you like once in Tasmania,BUT if you ever leave(or are deported) you cannot re~enter(for work at least).
If you mother is subject to re~posession, and you return to the UK, you may find yourself financially liable if the house sold for negative equity.
As far as your location goes,YES if someone knows where you are they are quite at liberty to tell your mother(if she needs to know)
I would not rush into this,it's real minefield that needs serious consideration, and I don't think you have done that;you are storing up many problems for yourself in the future.
Thank you very much for your response it was very incitive, can i ask tho...if agencies here abt the default mortgage how can u be so sure they would contact immigration and get me deported can you back that statement up please? or how much do u feel this to be true???
in a pickle*...thank you again, *hands you roses chocolate box lol kiddn*

I assume you have your ETA organised? Also, there are rules regarding applying for various visas to stay in Australia whilst you are located there. I am under the impression that just because you marry an Australian ,you do not automatically get the right to live there permanently. I think, and I may well be wrong, that an spouse visa in your case will be issued with a 2 year validity. At the end of this time, you have to prove the relationship is continuing, and then it is extended for another 2. After this, I think it goes to a full PR, although after 2 currently, soon to be 3, years of residency, you can apply for citizenship.
Take it from someone who has emigrated to Oz, it's not as simple as packing a bag and buying a ticket. The DIMIA are a real pain to deal with, and they take a very hard line on immigration compared to the U.K.
The australian govt will NOT deport you because you have a bit of debt in the U.K. People like interpol are really not interested in your debts. They have far bigger things to be concerned with.
As an aside however, and bearing in mind I don't know much about you, your situation and you mother, I do think it's a bit harsh to dump this all on your mum. Sounds like a bit of a whim to me, and you need to think carefully about shafting the person who has raised you, and whether it is all worth it. If it doesn't work out in Oz, you'll face up to all these problems when you have to return to the U.K. They won't just go away. Problem then is, you won't have anywhere to live. I wouldn't put you up if you'd done this to me.....
