My wife and I seperated over 10 Years ago and never actually got divorced, she has recently informed me that she has now met someone else haand wishes to get a divorce.
I am listed on the mortgage as the sole owner of the property where I live but although she lived here whilst we were married for a couple of years she never actually but anything towards the upkeep of the house or anything towards the mortgage repayments although at the time the house was in negative equity.
I would like to know if she is entitled to anything from me financially as we have been separated so long as she has paid nothing towards the house in anyway shape or form.
Unlikely i would say, she probably wants a quick divorce and if she tries to claim anything she would have to fil in a full form E from the counrty court as would you, that would nead to include evry single detail about her income, savings, employment, outgoings , debts etc. Plus pension plans . I doubt she would want all that to be revealed at all. As well as information on any live in partner's income if they were living as man and wife.
If you get a divorce, just because there has been a long time while you were separated it still applies that the 'marital pot' means everything you own, everything she owns and all of your debts, and your pension and her pension. So she may want a quick divorce and agree to your terms, but I think she would have a claim on your property as your wife.
