3 months ago my father-in-law died leaving the house in which he originally had a joint mortgage(fully paid) with his son, which he then left the house to his son.
The son lived there with his father, wife and two children. The wife now has declaired that she wants to leave the partnership because she no longer loves the son.
As the son has only had full ownership of the residence for 3 months is the wife entitled to any share of the house or part there of.

Yes - the period of ownership is irrelevant. The basic presumption is 50% negotiable up or down depending on other factors.
