Perental Responsability Orders
My husband wants to get a perental responsibility order for my children he is not there father is this possible ? and if not what can we do to ensure that he is responsible for them legally without having to adopt them?

I think this may be different if the biological father refuses to answer court questions. Try and get some advice from the CAB (Citizens Advice Bureau). They may also be able to put you in touch with a solicitor who deals with such cases. But, as I say I am not an expert. You need to get good advice from a solicitor.

up until about 4 years ago, it was possible for anyone to apply for parental responsibility. This is particularly relevent if the person applying normally lives with the child and the courts usually grant this barring any really horrible reasons, as you are not trying to change anything with regard to the child. By having parental responsibility, you are simply stating that they can sign an aesthetic form or a apply for a passport on behalf of the child etc etc. Also, multiple people can hold parental responsibility for any child biological and non biological. The natural father will not have parental responsibililty by default unless he was married to the child's mother at the point at which the child was concieved and born, or he lives with the child permanantly.
I'm not sure what the document pinkfizz refers to is, it could be a new legislation, however, it is always advisable to check with a solicitor. There is also a very good book called "Understanding the children's act" which is available from all good book stores, or amazon, it is very informative and I would advise getting it.

Found this as well which agrees with mimififi - very confusing! As neither document has a date on it I suggest you contact a solicitor and see which is the latest and correct one.Good luck.

In answer to pinkfizz my husband wants a parental responsability order because he has acted as their father for nearly 8yrs but he has none of the legal rights of a father so if i wasnt around for any reason he would not be able to make decitions on their wellfare,....... and no my childrens father does not have a PR order. Allthough he is trying to get one even though he hasent seen my eldest child for nearly a year and hasnt seen my youngest for 6mnths through his own lack of interest ..it now seems he wants this order just to disrupt and make me unhappy. NOT because he wants the responsability of my children ,
