recently i had a fight with my brother at my house. it started when he got aggressive without any real reason and grabbed me round the neck to strangle me, i punched him off me then asked him to leave my house, he wouldn't go so i threatened to ring the police he still would not go. he then snatched my phone off me so i ran up stairs and locked myself in my room, he was taunting me and shouting asking me to hit him again, then it went quiet, i assumed he had left so i went to see if my phone was left outside my room. he was still downstairs, i asked for my phone back, he threw it against the wall so i pushed him and asked him why he did that, he again tried to strangle me so i punched him off me and fell over, he was hitting me in the back of the head so i picked up whatever i could blindly grab and used it as a weapon to beat him with behind me until we both colllasped in pain and worry. he later violently left my house but wants to press charges fo assualt. he recieved a broken hand black eye bruising and concussion, i recieved bruisng only. what is the likelyness that the police will charge me? and will the fact we both had drank alcohol make any difference?
TBH you may get charged but if you do then it will be a caution for the pure fact of the circumstances around it.
One thing you should maybe put forward is that you will press charges if he does, quite often comes to a conclusion that the police and solicitor will use it as a bargain, police hate family related problems they will try and use the idea of "both accept the cautions and its the end of it"
