I don't pay to house bills only pay some to food shopping and buy children's clothes and pay for school trips and extras, Christmas and birthdays. My mortgages flat is let out. But how would I stand if I asked a solicitor? I am trying to save costs to see a solicitor had thought about CAB but spoke some time ago and bit vague and referred me to family law solicitor. I have read I could be given permission to live in his house until girls were adult but somewhere read permission for just 6 Mths. I am very worried about break up for children let alone any arguments about this. I just want to know where I stand. My flat is one bedroom small with lounge kitchen and not big enough for us to life in. Also if he did move out how can I affor council tax and bills how to people manage. Thank you
It is quite difficult to understand what you are asking however if you are saying that you live with your partner in their house and you do not contribute towards the mortgage or the bills then you have no claim to maintenance or to the property if you split up.
You stand out in the street homeless.
If you are not married you are just a person who shares a house with someone else.
The house and estate will go to his children who can then do what they want with it. There is little chance for you.
I am not sure what you mean here by ''I have a mortgages flat'' do you mean you have another home? if so even less chance of getting anything if your partner dies.
The only way you may get anything is if your partner has made a will benefiting you over his children but even that is likely to be contested particularly if you have your own flat somewhere.
I think she's talking about splitting up.
I think - if I understand sewme correctly - that she is thinking of leaving. She won't get anything if it's his house and her name's not mentioned, and she doesn't pay any bills. He does have an obligation to keep a roof over his children, if she takes them with her - but that's child maintenance, not a case of her getting a share of his house.
As you have now confirmed you have your own flat which is let out, you have both a home and income, so you will get absolutely nothing if your partner dies.
You will have to end the tenancy of the people living in your flat and move in your self.
By the way, I hope you took out a' buy to let' mortgage or you may have the flat repossessed as well if the mortgage company find out.
^ and if you have your own flat with a tenant in it, you'll have to wait until the tenancy is finished, to take up occupancy again.
I am reading this as the children being the partners kids but I may be wrong.
Are the two children yours or his?
i was thinking along the same lines Eddie.
Eddie who said anything about the partner dying
Ok, I see it is a split up but she still gets nothing, the death of the partner needs to be looked at if the living arrangement is to continue as she will end up on the street.
you stand much worse off than if you were / had been married [to him ]
What about the children?

It seems she and her boyfriend are the parents.

Christ you're cheerful tonight Eddie. I would guess the partner dying is the last thing on this lady's mind. Also you are talking a load of bull in my opinion
Is everyone reading the same post as me? The poster want s to leave the partner, not marry him or kill him!
I'm reading it the same as you.
Yep bednobs - marriage not going well, wants to leave.
