As my brother is very ill my sister and I do believe it will be his first son who will take care of his business.

There is no legal definition of next of kin. It doesn't have to be a close relative. Since your sister is still alive ask her who she wants to be her next of kin.

It is whoever she nominates, it could be a friend, not a relative if she chooses, but if she should die intestate then there is a strict hierarchy of how people will inherit- starting with spouse, then children ( equally- not just the oldest).

If it is a case of intestacy, the estate will be divided between offspring in equal shares. If there are no offspring, the estate will go to siblings in equal shares. If any of the people mentioned above have died, and have offspring of their own, their share will be divided in equal shares.

JJ as stated above, your sister can put anyone on a form (Hospital/Dr?Insurance policy etc) as next of kin.

As regards what happens after death, the person needs to make a clear and valid will or the laws of intestacy take over.

jennyjoan, it is really only an issue when authorities need to know who to contact such as the hospital when a person is admitted, the police when somebody is arrested (maybe) so there is a point of contact, someone who the patient is happy for private matters to be discussed with.

My GP has my nominated next of kins details, one is my wife and the other is a trusted friend because if I am in a car accident of plane crash it is highly likely my wife will be with me.

In a will, the next of kin doesn't come in to it. You name the beneficiaries who don't need to be family and the executors, who can be anyone you want.
