Is a Kit - Kat a biscuit or a sweet????? PLEASE HELP

It's described by many as a chocolate bar, but in the marketing business it's placed in the 'sweet biscuit' category.
i'd call it a chocolate biscuit
It was originally called 'Wafer Crisp before becoming Kit Kat in late '30's. Suggests it is a biscuit.
Jonathan Ross had this discussion about Jaffa cakes . His criteria to tell the difference is if you leave cake out it goes dry if you leave a biscuit out it goes soggy since neither of these apply to a kit-kat I would say sweet. we are also charged VAT on anything coated in chocolate
My theory is if you buy it yourself at the shops and eat it there and then, it's a sweet (chocolate bar). However, if I go round to my mums and I take one out of the biscuit tin, it's a biscuit! That won't help you one iota, lol!
i like kitkat not had one in ages any going spare ?
Go round me mums crete, she's always got some in the biscuit tin. I'll tell her to listen out for you!
