in about decemember 2007.. to januargy 2008, i was overpaid 550.. now i thought this was a xmas bonus because i was expecting to recive one.. so thought nothing on it.. spent all the money and then a few months later recived a letter saying i owe them the 550 as it was a mistake from them and need 2 repay it asap, i asked friends and family on what i should do.. they said just forget about it.. they will not take it to court cos it would cost them money.. well a year down the line and they took me to court.. now wanting 800.. i recived a letter a few days ago saying they took me to court, and won, and won a settlement for 100 a month payment.. now i cant afford this at all as my hours have been cut drematically at work..
is there ANY way at all i can get out of this?..
i dont want to pay a penny back, i feel robbed.. i gotta pay all this money back through no fault of my own and thats not to mention the bad credit rating im gona recive! ..
any help would be greatly appreciaited

i havnt worked for them since this happend.
after about 6 months they sent me a letter saying the credited my account with them with the amount of 550 so if and when i worked for them they could take the money from me that way..
and the thing is, i was paying emergancy tax with them.. and havnt ever recived a tax rebate since i started work when i was 17.. and im now 20.
more to the point, is there anyway i can get out of paying this money cos i cant afford it AT ALL!!

when you recieved the CCJ there will have been a form in it offering you the opportunity to present a defence to the district judge, and you could have gone to the hearing.
now all you can do is send the form back and ask for more time to pay. Your tax would have automatically been adjusted after yhe end of the year if you had not used your full allowance for that employment . Ask at the tax office, do you have your p60? the firm you owe this money to will have sent you one in the april.

all i can say is that you were given VERY bad advice from your friends. you say "no fault of my own" but as soon as you realised or were made aware there was a mistake you burried your head in the sand, which has now resulted in probably being unable to apply for credit in the future, having a ccj - the original mistake was theirs but unfortunately all the subsequesnt faults have been yours. If they had made a mistake and underpaid you, you would have expected the payment to be made back to you. They have made (very) reasonable approaches to you, so they had no choice but to take you to court. There is no way of getting out of this. You will have to pay
