We have a charge on our house dating back to 1984 we did not know it was there until we went to sell, now the company say they cant find records, but wont take off , were do we go from here

is this relating to a loan that you have had or does it predate you? I certainly wouldn't be offering to pay them anything unless you know you owe them money. As I suggested earlier, go back to the and ask for PROOF that they are entitled to have a charge on your property and if they can't supply proof, then require them to remove it. As I suggested earlier, go back to the and ask for PROOF that they are entitled to have a charge on your property and if they can't supply proof, then require them to remove it. You might also ask whether they have records of any charges on houses with a similar address as its not unheard of for mistakes to happen and the charge to be put against the wrong house.
Hang on, can we go back a step. Does the date of this charge PRE-DATE you moving into the property? - if so, suggest you refer the matter to the solicitor who assisted you during your buying process. It is not something that they should have allowed to go unchallenged (and therefore that solicitor ought to have the hassle / expense of getting it shifted off).
