Fence
Im really annoyed. We put up fencing over 5 years ago between our neighbours garden and ours. We have just employed a handy man to re stain our fence on our side, i have just had a call from the neighbour saying that it is our responsibility to re stain her side too as it states on the deeds that her side of the fence must look better than ours but surely this does not mean we have to pay for her side of the fence painting. Nothing would have been said if we had not decided to re stain out fence. Please help, im shaking with anger.

Just ignore the call though Although it is usual practice to erect a fence with the 'wrong' side facing you, it's not a legality and as for her deeds saying the her side of the fence must look better than yours well........................................ (

The fence is on our side of the boundry line. Iv just spoken to my husband and he says that he will take the fence down at the weekend. The problem is that this woman will do anything to save money. When we put up the fence and stained it, she did not ask us to do her side, so why after 5 years do we have to stain hers. It looks lovely by the way but its been spoilt by her now.

If it is your side of the boundary line then you don't have to do anything at all. You could paint the whole thing sky blue pink! It has nothing whatsoever to do with her. If she doesn't like the look of it she can put a fence up her side of the boundary line.
Tell your husband to leave the fence where it is. No need to refer to any deeds whatsoever!!

To be honest, she can't stain her side of the fence without your permission. It would be interfering with your property and trespassing onto your property to do it, as it is your side of the boundary line.
I would tell her that she has your permission to restain her fence if she wants it to look better and explain that the fence has nothing to do with her - it is in your garden.

Seriously, I wouldn't give it another thought....and I'm certain that your husband has better things to do than take down a perfectly legal and legitimate boundary fence. I understand that the 'confrontation' will have unsettled you but she is really just chancing her arm.
Restore your piece of mind and treat her bluster with the contempt it deserves.
