can a tenant of a top floor flat have their tenancy agreement terminated on the grounds that there is no valid gas safety certificate and/or no means of escape (other than the main staircase) in the event of a fire?

I doubt they can on the fire escape issue but I'm sure the Landlord is required by law to have a gas safety certificate on any property where gas is present.
I would say no because it is the tennants responsiblity to ask to see the safety cert and they knew before taking the tenancy out that there was no means of escape.
Evian I agree with you - but would you as a tennant not ask to see the cert before signiing the contract - I know I would!
Can't say I've ever thought about asking to see it to be honest, knowing that my LL needs to have one by law.
are you supposed tp have more than one means of escape?? If my house caught fire while i was upstairs, my only means of escape is the main satircase
you are supposed to have an escape plan but not a fire escape if that makes sense.

no I don't think you are supposed to have more than one entrance - when we lived in london lots of my friends lived in top floor flats and not one of them had a fire escape!
