Joint Access To Rear Gardens

hi all after some advice please
I have lived in a council house for the past 3 and a half years with no problems what so ever.
But 2 month ago I get a new tenant move in next door to me who is private landlord and the trouble starts over the access to my back garden I live in a block of 3 houses together each end house has there own access and I have the right to use the access round past the new tenants house (which I have done since I moved in).
But sinces shes moved in ive had police at my door and council shes filled there heads full of well u no wot I was going to say shes told council that I have no right over this access and she will be chaining bins up so we cannot use this access (now if I'm right the back of house is still deemed as a fire exit) so she cannot do this her land lord has said theres no way she can stop me using this access but shes having none of it I'm at breaking point as no one is listering to my right is causing argument after argument an any one HELP PLEASE

The landlord of the OP's neighbour has bought the property at some stage so it will be registered with the Land Registry. The Title Deeds will show any access rights over the property which I would trust over any estate agent who in any case acts on the seller's behalf.

If you do a google search of the address you may find the estate agent's listing which might prove interesting.

OK but ,the questioner states that she is a council tenant her terms of tenancy must include the right to access if it exists. Two of my family live in council houses with this type of shared access,both have the right written into their tenancy agreements. These also state that it is an offence to block the access. One of their next door neighbours have out up a gate with a lock but my son has a key to it for access .They did it by agreement as they both have dogs that they want to keep in their own gardens.

errrm Eddie, I asked the OP who told her she had right of access and the OP didn’t answer......also its not unknown for councils to get things wrong or forget to inform people of things.....Again I say First the facts, then, if necessary, the fight.

True woofgang, but I was assuming the local councils housing department must know the situation re access and asking them would seem easier /faster/ cheaper than going to the land registry and paying a fee to search.

EDDIe why would you assume that? There are departments in my local council who i wouldn’t believe if they told me it was raining on a wet day!

sorry not been on in a while but was in a accident well the landlord has been to see her again and has told her under no to chaining bins up and that it is in the deeds of her house that I have access went out this morning to but rubbish out and shes tied the bins up blocking our access again this has got me to the point where I'm pulling my hair out ive used this access for 3 and a half year with nothing said as people no I have rights over the access she moves in and is there 2 minutes and thinks I'm not allowed to use it shes not listening to landlord shes just doing wot she wants

then you need to go back to the landlord and keep going back.

cannot cut the string as it would be classed as criminal damage my local parish councillor has seen the land lord again tonight who says she will go see her tenant again just go enough going on with my own health I don't need the stress and that's all this is causing councillor rang council and they are ignoring her after 7 phone calls land lord seems to be working with us but tenant and council are not we r stuck between a rock and a hard place
