Tree roots blocking drain. Owner refusing responsibilty.

Hi,
I live a close with two drains. Everytime it rains heavily the road gets flooded. We have had it inspected and have been told it is due to the roots and leaves of a tree that is owned by someone in the joining road. The owner denies the tree is his as it is outside his hedge. Our close is full of old people who can remember the tress being planted by the former owner years ago. How can we prove the tree is his responsibility?
