A) can you be caught speeding on a camera with a 'testing only' sign attached?

B) If said camera is in a rough area and the sign is no longer there is it beyond reason to think its just been removed by kids?

C) should I expect the police to put a sign up stating camera now in use?

I'm asking because I have been caught speeding in this situation

I think you're clutching at straws wi the second two questions.

The law does not require drivers to be warned about the presence of safety cameras. However, there is a National Safety Camera Programme and those taking part in it must erect signs at certain distances if they want to recover money from it.

The rules and guidance can be found in the Handbook of Rules and Guidance for the National Safety Camera Programme.
A probably not but I wouldn't be surprised.
B It's not beyond reason but it's just as likely the testing sign has been removed because the camera is now operational. Or that kids put the testing only sign there as a joke in the first place.
C No - in any case a generic sign probably exists somewhere in the area.

It would appear you knew there was a speed limit, knew a speed camera was there but carried on speeding regardless. Don't expect sympathy.

Be wary of too much reliance on Pepipoo it has some good stuff but is sometimes out of date in terms of case law. I believe its run by mtoring lawyers so always remember the golden rule about solicitors duties :-
They have a duty to protect their clients interests
They have a duty to the court
But the most overrdiing duty is to make money for themselves!

I have never come across a camera being tested and cannot see why it would be necessary - if the device conforms with the Secretary of States requirements and it has a currnet calibration certificate then there is no need for anything else to be established.

I think you are simply going to have the accept the consequences

do you know the speed limits

if you have a licence the answer to both should be yes

stop trying to blame speed cameras for you being an idiot. Like it lump it, speed limits are there for a reason - follow them!!!!!!!!!!!!

don't speed, don't get caught, don't get point or fine, problem above doesn't exist

it's like saying I murdered this bloke but there was no sign saying I couldn't do it - sorry doesn't cut it

I hold my hands up to the offence I was merely asking a question in regards to the law.

I was not aware asking a law question was asking for sympathy?

on the occasion i was keeping up with the traffic i have a clean licence (for 12 years), it was a dual carriage way with new speed signs (but i presume my fellow motorists thought were part of the test) as even the local police were averaging 40 it was now a 30 zone for some reason!

This is a law section and the law should just be interested in the facts of legality and not some uneducated infantile rant by some sad jerk Matthay
