EBay refund

I pre-ordered an X Box game from what appeared to be a reputable seller on EBay and he was unable to supply the item. I was annoyed but his e mail (to all 1,500+ people who had also pre-ordered it seemed to be genuine - something to do with Paypal limits, etc). However, that was over 3 weeks ago and I have not received my refund of £40 (so he is in effect sitting on £60,000+ of other people's money). I have emailed him saying I would like it back and if he responds by today I will not give him negative feedback. I am cross that he has not responded and I want my money back - how do I go about this?

Sherrard, don't give negative feedback until you have been through the Resolution process with eBay - there may be a genuine reason why he can't deliver. Open a dispute in teh resolution centre - you have waited long enough now - and eBay then get in touch with him. If not resolved within a given time they can instruct him to refund your monet - it's a straightforward laid down process. EBay don't want people giving the site a bad name, so go and do it - if you click on the eBay Buyer protection flag on your front page, it'll give you a link to the Resolution Centre. I've found it helpful in the past and either the transaction has been cancelled and money's been returned, or the item has been delivered. (How do you know he sent it to 1500 other people btw?- if so then mention that in your complaint). Good luck, let us know how you get on.
PS ^^ I wouldn't go direct to the PayPal dispute centre yet (sorry naz) you need to try to resolve it on eBay first, they will instruct PayPal if need to be to refund your money. Here's the eBay link http://pages.ebay.co.uk/ebaybuyerprotection/
As you wish, naz - but since it's a eBay-registered seller, I've always done it that way, and it's worked for me. If your way is quicker then good, but the few times I've had problems with eBay sales or purchases, their resolution centre has done the trick for me. eBay don't want duff sellers on their site!
Thanks both - I have opened a case with the E Bay resolution people - I was feeling quite sorry for the bloke (he did seem to be having problems but I am not here to fund his money-making business). If he responds promptly I will not give him negative feedback as everyone has problems. If he does not respond promptly then I will be giving him stinking feedback.
