2 week ago I dropped my phone and it stopped working so I took it back to the shop I bought it from when I took out a 24 month contract in july 2012. I was sent away for repair but after 2 weeks it came back with a engineers note saying it was repairable but seeing as I had not took out any insurance I am stuck with a phone that don't work and 8 months left on the contract. Other than buy a new phone to fit my sim and get my moneys worth I was told to claim on my house contents insurance. As it was dropped on the stone floor of my property, have I a legal claim for compensation ?

If you have accidental cover with your home contents insurance, yes it should cover it.
Do you mean a valid claim from the supplier or on your home insurance. Re your house insurance I think it depends whether you dropped it in the house/within your property or away from home. To claim away from home, you would need to have protection away from home for it to be covered to which you would have paid an additional premium. Not sure about the supplier if you dropped it then really it is down to accident not a fault.

yes I have home contents insurance and I am wondering if I have a valid claim on my contents insurance cover,and yes the phone was accidentally dropped inside my home . What my main worry is will my home insurance quibble over the phone been running valid contract with talkmobile
If your home insurance covers you for accidental damage then you will be able to make a claim from them.
Read your paperwork and/or phone the insurance company tomorrow.

Whatever happens you still must pay your monthly mobile phone bill.
Your insurance company will ask you if you have any other cover in force which covers your phone - if you don't,. and you have accidental damage cover for your personal possessions, then they may well accept your claim, but it depends entirely on what your policy covers. The fact you have a contract with a phone supplier shouldn't make any difference, if you didn't insure the phone with them.
The only thing to do is make contact with your ins company to see how to proceed. There will be an excess I would imagine.
think about this. after you have claimed on your home insurance, your premium is likely to go up. Unless the phone was avery expensive bells and whistles one, you might do better to bite the bullet and replace it yourself rather than claim on home insurance.
Good point - if your excess is say £200, you might find you wouldn't be able to claim anyway, if the phone costs less than that to replace. Your first step must be to check your household contents policy.
Have you been told how much it would cost to repair?
also, if it is a whizzy/expensive phone, then it will be well out of date now, and you might be better off upgrading your contract, or buying a cheap phone to use till you can
