Accident without ins!

A neighbours son of mine took his car out one evening and had a bit to drink so he handed his car keys over to a friend to drive home. This friend was uninsured to drive the car and had only passed test within a few months. The friend was overtaking and hit on oncoming car head on.

Both cars are written off. The son is still in hosp but they arn't told anything about the person in the other vehicle.

Will there be? and What are the criminal implications for this?

They will both be prosecuted - one for driving with no insurance, the other for permitting, and the penalty is the same.

6 to 8 points and a fine.

The friend may also be prosecuted for careless driving, dangerous driving or similar. He will certainly have his driving licence revoked and returned to learner status.

The innocent motorist may bring a civil claim for the damage to his car and any personal injuries.

Really hope the innocent driver isn't badly injured! I also hope lessons are learned!!!

I think they will let him off lightly in the fact that he handed the keys over to his friend. Although his friend should have know to be a bit more careful.
4getmenot - no they won't. Permitting another to drive without insurance is as bad as driving without insurance.

At least if the son had had an accident whilst drink driving, the innocent motorist would have had a chance of gettting proper compensation for his injuries,and not have to rely on the paltry payout from MIB.

The son should have left the car where it was and got a taxi home.
yes it is but thats what I think. No-one know if they will or wont. Most of know he should have got a taxi but hindsights a great thing and andrea is asking what will happen now. Have you heard about that man that drives a little fold up scotter and as long as insurance is ok you can ring him up he comes to pub puts his scooter in boot and drives you home in your car. I think thats genious

Hi all, thanks for you replies. Still no news on the other person, but it sounds as if he is fine (other than rightly upset), but the son is quite bad though, he might have to have his splean (spelling??) removed! He's in a neck brace too! Don't think he'll be behind the wheel for a long while!

My neighbour is besides herself with worry over it all, think she's best thinking about her son for now and then accept the conciquences as they happen!
