accident on a mini roundabout

My boyfriend and i recently had an accident on a mini roundabout. We were approaching the roundabout with a turning to our left and the traffic traveling in the opposite direction to us. When at the roundabout the car infront of us went straight on, my boyfriend looked, checked the car to our left and infront of us wernt turning on to the rondabout and followed the car on, hence we were not traveling very fast, the police concluded about 8mph. We just came to go round the roundabout when out of nowhere a van was coming straight towards us on the roundabout. It was going quite fast and hit my boyfriends car on the front right side with the front right side from the car. He jumped out the car and told my boyfriend he was at fault. However my boyfriend said he did not see his winker on and that we were also on the road when he came round and crashed into us. The man later drove his car off fine and my boyfriends has been towed away and is prbably going to be a right-off. Neither is claiming libility. However someone said to us it will probably be put as 50/50 because we should of given way to our right. But there was a car on his right who wasn't going because we were on the road, plus we were to his right aswel.. Once the crash had happened we had to reverse to go dwn the the road he was trying to turn down because when he hit us we had already gone pass the turning and was on the roundabout, so doesnt this prove we were on the road first when he took the turn on to the roundabout???Im really not sure on the rules of mini -roundabouts and would be grateful if someone could explain to us and tell us where they think we stand.
