car insurance excess
my car was hit this morning by another driver, he was at fault. I phoned my insurance company and gave them all the details and his details. They booked me in for a quote for repairs and the repair company have told me i have to pay the excess. I was not at fault so I should not have to pay this, is this correct?

Strictly speaking they have no legal liability to recover this on your behalf, hence it is always a good idea to purchase Legal Assistance for this and any other uninsured losses (petrol, additional expenses etc) however most insurance companies will ask for your excess back as well when they recoup their outlay. Should the third party not accept liability or the recovery become protracted, the insurer has no liability to pursue it (or even their outlay) if not financially viable.
