Suspension from work
7 Answers
Someone I know has been suspended from work, on full pay, and doesn't know why. When he asked why he was being suspended, his immediate manager told him that he would be writing to him outlining it and that he wasn't prepared to discuss it. Keith (my mate) then asked his manager what would happen and was told it was up to the board to decide if it was gross misconduct and if it was then he would be instantly dismissed. Keith asked his boss if he thought it was something under gross misconduct and his boss just said he wasn't willing to discuss it, he would be written to.
Surely this isn't right. Can someone be suspended and not know why? And how long can you be suspended for? And is it right that the board decides if its gross misconduct?
I have asked him what he might have done which would be construed as gross misconduct but he hasn't got a clue, as he can't think of anything, and this suspension came at the end of the day as he was walking out of the door - his security pass was taken off him so he can't get back into the building now either.
Thanks in advance for any help.

Clearly there are things that you dont know -and a few other things that keith (your friend) doesnt know
Are they paying him ? If they are they can do what they like really.
when it comes to a disciplinary, the firm has to follow its own disciplinary code - which a small firm may not have - and the Rules of natural justice. They only thing is, that if it is a small firm, then separation of powers (different investigator, different judge, and jury may all merge into one)
If they are gonna hold a disciplinary, then he must have been told what the charges are - although perhaps not actually see the letter of complaint.
Keith needs advice.
Summary dismissal - dishoneaty - stealing - drunk while at work, fighting.....I mean he should actually remember something like that .
I wonder if someone has alleged he has been stealing

Thanks for that Peter. I said the same thing, how can you not know what you have done if it's so bad it might be gross misconduct. I can't understand how you can be suspended and yet not be told, only sent home to await a letter. What is the timescale for the letter explaining what the charges (is that what they are called?) are? He hasn't received any letter yet. No-one else can figure out what he's done either, so we can't help him - also, we are not sure if as work colleagues we are supposed to be talking to him although he wasn't told not to talk to us, and no one has mentioned anything to us. We have just been told he's taking "personal time". He definately hasn't been drunk or fighting and I haven't heard of anything going missing either.
