My mum's friend is opening a cafe next spring and said that I can have a job as a waitress. She knows that I go to cadets and her and mum agree that mum'll fill in for me when i'm doing something with cadets. But for legal purposes, how will we do this? Will she have to employ us both properly. Imagine if she has me but not mum down as an employer and some kind of inspector comes on a day mum is working instead of me, she doesn't look like a 17 year old . . . . . the last thing we want is for her to get into trouble. is the best thing for her to employ us both on a very part time basis? Also because she knows we're reliable, if someone else is ill there might be a couple of days we could both work perhaps . . . .

Your Mum can be just helping out.
No, she should be A ZERO hour contrcat employee, which means no contrcated hours per week but she is able to do any hours as and when required and the tax and insirance would be applicable with each pay packet. She would not accumulate holiday entitlement but it gives everyone the legal flexibility needed.

We just don't want her to get into trouble . . . .
As long as she doesn't pay your mum and only pays you, there's no problem. You could give her some money if you wanted.
Both if you want, makes no difference really, it gives alot off flexibility to both sides.
How will she get into trouble?
Are you assuming that your mum's friend lacks the mental capacity to sort out these things for herself prior to starting up her own business ?
What kind of inspectors is she expecting?

the inspectors she will get as a cafe selling food to the public will be more to do with the food hygiene legislation and the local authorities health and safety dept than any employer or employee person from the DWP molly, but it is a possibility especially with a new business operated on a small local scale.,
Very unlikely though. I ran a business for about 6 years and never had an inspection.

It's not illegal to have casual workers.

Ok, just checking. Plus i'm going to be working there before it opens, helping to decorate . . . .something mum hates so won't be doing, but of course that'll count as casual work.

Dotty, my second job is on zero hours, but I still accumulate holiday entitlement for any hours I work - and get paid for this every six months.

I think it is Euro law to stop discrimination against part timers.

but you only accumulate holiday hours based on the hours you actually work. on weeks when you do not have any hours there is no holiday accumulation surely,
