i have a lad who works for me who i took on because i could no longer stretch myself and had to take on 1 extra pair of hands!! however, week 5, and he still is not motivated enough to do anything,is unwilling to learn, slow, stops if anyone else needs to stop(toilet break kinda thing) when he goes out in the van he gets back at finishing time?

i thought it was a nervouse thing at first, i give him things to do,targets to achieve and i have had a word with him about his work rate....but to no avail..

so.... do i just say its not working out and sack him, whats my legal standing??

i will be speaking to my acountant on monday anyway but in the meantime??

you can sack him at any time up to a year but i think you have to give at least a weeks notice but if he has only been there five weeks i think you can tell him just to go
He can't claim unfair dismissal until he has been employed by you for a year.

This is a useful site for you:

You can just dismiss him giving a week's notice. He probably won't work the notice anyway.
is his name shaun! I worked with someone like that for a year! till he got sacked
most places but new employees on a probationary period for this reason......so in the first 3 months you can dismiss an employee without giving notice and they can leave their role without giving you notice. Has he signed a contract? You could just make his position redundant and say you no longer have the work for him.....last in, first out!
