if a company has made you redundant are they oblged to offer you your job back if they start recruiting again within 4 months.thanks

Is the role identical- they will probably claim it's not. Did you get redundancy pay and did you sign a compromise agreement?
With these answers i expect Buildersmate will know.

I wasnt made redundant but 19 other employees were. The company has notified the dept employment that up to another 80 could be made redundant in 30 days. By the same token they have informed the workforce that by august they expect to be busy again and will recruit temporary labour from a recruitment agency. Surely they should give these people who were made redundant the oportunity to return even if it's on the temporary basis . They say they will only make future recruitment through an agency, which will mean that the ex employees would be on a much lower wage if they came back this way.
I'm sure the company can do this and I'm sure they could justify their use of agency staff although i don't think they need to justify it. And those people who got redundancy pay would have got it tax free (well the first �30,000) so the HMRC would want the tax back if the company took them on so soon
This sounds like they are downsizing the workforce baseline to lower threshold and planning to use temporary staff to deal with any future peaks.
The last time I dealt with this situation I remember the guidance I was given was that one cannot recruit for the same role agin within 3 months. I am not sure if that is enshrined in any legislation, or just the legal advice I was given by my companies lawyer.
No, there is no obligation (and probably no reason) to bring redundant staff back again first.

thanks a lot buildersmate, thats pretty much what i thought . everyone at work was asking the question so i was sure someone would have good advice on this site as usual.
