There is NO chance now of being charged with an offence, just carry on as normal. Did you not say you were trying to avoid a car that overtook you too closely? So there is no carelessness any way.

a case where the county is the plaintiff against the insurance company...there must be a disputed claim somewhere...?

i thought so you both look alike.
i guess the insurance are disputing to pay out.
will i have to go to court
perhaps..but a lot of these cases are settled without court proceedings going ahead..depends how much is involved !

What is on the statement? I assume this is over the time you hit a fence & the fence owner is trying to claim £50,000 damages?
for that much then most likely this case will proceed to conclusion

yes thats the one - the statement asked lot of questions about the car, what lights were on, if i remember hitiing thefence, if the road was clear, and how badly did teh car get damaged, all about me really.

if the county are pursuing a claim with their insurers who are refusing to pay out it is likely the county will contest that decision legally in order to obtain what they consider to be rightful..their contract with the insurers will be scrutinised from a legal perspective and if the insurers are deemed to be in breach of contract by refusing to pay..then they will be ordered to do so..
60k for hitting a fence is extortionate.

ok, how does that effect me, and this witness statement i have had to do?

OK just send it back. That should be the end of it as far as you are concerned. It will be about the fence owner trying to claim such a large sum for a simple claim. As I remember his claim was that the fence was next to a wall, the wall was demolished which in turn destroyed some very expensive furniture or works of art.
He is going to have a hard time proving it, but that is not down to you.

eddie51 I do agree with you, just so fed up of the whole thing I mean I did,nt even hit the wall ( there was no wall) just a fence.
I don t know what what behind the fence.
I dont think it was worth nearly 50-60k
