Either way, you can't sue for something like that, unless you did yourself some serious damage with the bit of polythene, which you'd have to go to court to prove.

Thats the problem these days, people automatically want to sue. Have you contacted the store or the manfacturer to see what they have to say. Mistakes happen and you will find that the majority of companies are very quick to try and sort out your problem, as long as you go about things in the right way. Don't try threatening them with courts and legal action, they will simply turn round and say go on then, and 99 times out of a hundred they will win. Be nice and the worst thing is you'll get the item swapped or refunded. You might get freebies vouchers or more but treat this as a bonus.
