driving offence
i had an accident last september. i was pulling out of a shop and was hit by another driver dangerously overtaking about five cars on a blind spot of the road. i thought i was to blame as i was pulling onto the road however the police decided he was driving with undue care attention. they told me he was going to be prosecuted and i was not. i then received a letter from my solicitor saying a summons had been issued against me even after the police said they were not prosecuting- they did say i might be called as a witness. could someone please advise on this. i have never received anything from the court since the solicitor contacted me two months ago. can you be summoned to court as a witness?

For more on marking an answer as the "Best Answer", please visit our FAQ.It wasn't served on his address he just sent me a letter saying he had been in contact with the police and that i summons had been served against me. do these usually some out in the post or are they actually delivered by the police themselves to the home address. i seem to be waiting a very long time on the summons

NTD, I think PLIVELY was asking because this site is 'the answer bank' - there is a clue in the title for you in case you're a bit slow......

All the solicitor knows is that a summons has been issued and if the police said they might prosecute when i had made my statement i would not be asking. It is the fact that they have actually told me that they were not prosecuting me, then tell my solicitor that a summons has been issued. This has also got my solicitor confused. Not asking for legal advice, just asking if anyone has ever heard of anything like this!
