Can i claim housing benefit for a house owned by my father
i recieve housing benefit for a house which i rent from a private landlord.
he has told me that the mortgage payments for the house i am renting from him have gone up
I spoke to the council and they told me i have to cover the shortfall myself as i allready recieve the maximum ammount of benefit.
There is no way i can cover the shortfall so my father has aggreed to buy a house and let it to me (buy to let)
Will i still be able to claim housing benefit?

Answers
yes it will be ok, cos my dad and i did the same thing, as long as it is done properly with tenacy agreement and rent book and all that, and of course you have to be seen to be paying the shortfall.

And what does that prove?
What you are saying is that Joko's father should let her live free of charge in his house if she is unemployed at any time, regardless of his circumstances. He makes his living by being a landlord and possibly cannot afford to let her live free of charge. Joko is not living off her father. He is contributing to the country by paying tax on his income the same as everybody else.
I still say there is a lot of envy on this thread.

coming in a bit late on this one -
Joko - if you are freelance and sometimes claim housing benefit - does that mean you are self employed?
Do you have to wait weeks and weeks for it to come through?
My husband is self employed and we have never bothered to claim anything - but when he is 'in between' jobs - it can be really tough living on one income and paying all the bills - however I doubt we would ever qualify for housing benefit!

To Overthetop
"Yes, but then I'm paying towards your rent, your father's pension, and, eventually, contributing to your inheritance."
Surely this is the case all over the UK where the landlord rents their private property out to any benefit claimant and then passes the property to their children when they die.
Whether Joko was the tenant or not is irrelevant as any benefit tenant would be paid for by the tax payer.
depending on the mortgage used to buy the property - then the rent may or may not pay off the loan secured on the house. If its interest only (as many buy to lets are) then the house would have to be sold to pay off the capital

glad to see some people are capable of grasping this very simple concept...and the "whatever...i agree with others" comment just demonstartes the level of ignorance and kneejerking evident on this thread...that no matter what the facts are...some will just 'choose' to go against...
cant say i care much though...my conscience is clear
the fact is...if i didnt pay rent, my dad could not afford to let me live here...so id have to leave and pay rent somewhere else...
nosha... thats exactly it...but ive run out of ways to explain it...also the house is owned outright, so no mortgages

I haven't read the whole thread - but enough to know the problem.
Whether we think that joko or hiblingz are obtaining housing benefit unfairly or even fraudulently doesn't matter.
If they both declare their circumstances honestly when filling out the HB forms then the housing benefit people will make a decision based on the HB law.
I used to work for DWP and have disallowed benefit that I felt should have been payable and paid benefit that I felt that a person shouldn't get. The law has to be adhered to regardless of personal feelings.

Joko... when you claim though - do you have to wait ages for the benefits to reach your dads account...
I always thought that if you were self employed - you had to wait 6 weeks for the claim to be processed - thus if you were in between jobs for just a few weeks you would be unlikely to put in a claim.
Thats the way it was years ago anyway!

I give up. Some people are just think they know it all. There is no scam. None whatsoever. If you think it unfair that some people have houses that they can rent out to relatives then so be it. Suspect read Joko's threads properly. She pays rent and when she is in a position not to be able to pay then she claims housing benefit. Just because the house is her fathers does not mean she should be treated any differently whatsoever.
Please explain how this is a scam. You obviously know more about these things than the DSS or the councils involved in housing benefit.
Doc Spock - what you mean is that you wish your Dad had had a property he could rent to you. But then you wouldn't have expected to pay rent would you. You would have expected your father to support you!

lol i know lottie...i am atonished how people can read perfect english and then twist it into a bizarre load of nonsense...
the self rightous ignorance of some is laughable - and is part of what is wrong with the world...that no matter what the evidence to the contrary some will hold their irrational and ill-informed opinions with such unshakable vehemence that reality and common sense go out of the window...it is attutudes like this that start wars and religious intolerance etc...
