CPS action?
I've recently been charged with common assault on my exgirlfriend. After having months of texts,hatemail , vandalism and abuse from her and her friends since our break up, I grabbed her coat and told her firmly to end all the hassle. I hadn't reported the abuse I'd had as my ex has bipolar disorder (manic/depressive mood swings)My solicitor thought I'd get a caution but my ex and the only witness(her best friend) exaggerated the story into strangulation and banging her head repeatedly against a wall. There were no injuries or other evidence to back this up but i was charged anyway. I have had no previous dealings with the police. Although techninically guilty I was advised to plead not guilty so the statements could be cross examined as we could disprove their story and maybe get an absolute discharge.
Since the 1st court hearing the two girls have had a drunken fight (not sure why)and my ex was badly beaten,including strangled causing heavy bruising to her neck. I think the strain of the lies has finally hit them. My ex has a history of depression and has since tried to kill herself and has been admitted voluntry to a mental hospital (or she would have been sectioned). Neither girl wants to go ahead with the case now. Will the CPS still want to go to court ?

It may be that the case has been dropped and although they may not be able to tell you this you should receive some kind of notice from the CPS in due course. Failing that, talk to your solicitor and get him to speak to the CPS about it.

Thanks for your reply Grumpy, thankfully the magistrates had the same opinion as you and I was cleared of any wrong doing. I'm still a little out of pocket and a lot under weight but things are much better for me.
My ex is still safely sectioned and her son is under the permanent care of his grandparents.
I have submitted a complaint to the IPPC as to find out why I was charged without any investigation whatsoever.
