abh charge
4 Answers
I have been charged with abh and am wondering if anyone can advise me on a likely sentence. I walked up and hit a guy who made my sister cry, then kicked and punched him numerous times after he tryed to get away. A few other friends also kicked him. There is cctv of the incident and it looks bad. It was drunken and outside a nightclub.
i am going to plead guilty
have cooperated with police
have no previous
am remorseful
have a job and character witness statements, including one from my employer
any ideas of what will happen?

The 'sentencing range' for such an offence is cited as running from a 'low' community order up to 26 weeks custody.
Those sentences actually apply to someone convicted after a trial. Your guilty plea will pull the sentence towards the lower end of the range but the infliction of repeated blows will probably cancel that out.
So I believe that a 'high' community order (of, perhaps, 200 hours unpaid work), probably accompanied by a fine, would be most likely.

It's doubtfull you'll go down . You seem to be following al lthe correct proceedures.
If I had a siser and a bloke made her cry I'd probably do worse.
Theres no arguing with CCtv don't even try to justify your actions by pleading not guilty.
You might get a big fine , probation , community service maybe. I doubt you'll go down. They'll probably string it out and make you swet.
The prisons are too full anyway. I done a lot worse than that and didn't go down.
All the best Nick

Maybe "Helpmetoo" could have put it a little more subtely, but in essence, he/she is only expressing what most people are thinking.
It sounds like you and your "mates" carried out a cowardly attack on another person, you admit to kicking and punching him as he tried to get away, then your pals joined in by kicking him as well.
Thugs like yourself, are ruining society with mindless violence, god only knows how far you would have been prepared to go if this lad had done more than "make your sister cry".
You should be taught a severe lesson and should receive the maximum sentence available, you have been advised to plead guilty in the hope this will reduce your sentence, I sincerely hope this fails and you are put away for a couple of years, at least the streets will be free of just one drunken thug who believes he has the right to take the law into his own hands, and in the most cowardly way possible i.e. like a pack of dogs.
Dont like this answer? Then think for a second next time you put the boot in.
And think about how your parents are going to feel when you're inside, and also about what could have happened, A few mindless kicks could have ended this persons life, for what, a couple of tears.
