I live in Scootland and my boyfriend was recently arrested and charged with assault to injury. I am the only witness, although there are hospital reports. He has been bailed and we want to stay together, this has never happened before and to be honest I think the night it happened our drinks were spiked but obviously It cant be proved now. The thing is, i tried to withdraw charges but the police wouldnt so it is going to court. Is there anything I can do now to stop things, he is so supportive as I have a few health issues and this was totally out of character. I would be grateful for any advice.

You can't. It's up to the Procurator Fiscal.

See "Prosecuting Crime"

unless the law's changed if he's gone not guilty and if you dont turn up at the trial there is no case! disapear at that time and the prosecution will have to offer no evidence and the case gets dropped! im giving you this advice under the notion that he's not a habitual woman beater and that he goes and gets help with his drinking, drug, anger issues, because if you want a happy peacefull life together, you both have to nip this in the bud now and never let something like this ever happen again! goodluck!
Not sure about this, but I think if you don't turn up at court, the judge can adjourn the case, and have you brought to court as a hostile witness, particularly as you have already tried to withdraw the allegation and been refused.
not sure about Scotland, but in England you could receive a Witness Summons, and if you still don't turn up a warrant could be issued for your arrest.
Did he assault you or someone else since you say you are the only witness?
