CPS Assault ABH

My Brother and i had a recent set to in a supermarket car park (not Busy). we were both injured. my brother called the police and i eas arrested for ABH. In counter sue I pressed for the same charge. What is a likely decision by the CPS and can the case be squashed if both parties drop charges at this stage?

It is impossible to read the minds of the CPS and we don't know what evidence is available to sustain a charge of assault occasioning actual bodily harm. By your own admission you were both brawling in a supermarket car park so quite apart from ABH charges the police and CPS may go for S5 public Order Act / Affray charges on you and your brother.

Thanks Pauln90 for responding so quickly. it was right on school run time so they.re were no kids about and very few people, and the incident was over so quickly. as far as i know there was not anyone around who feared for their safety(affray?) the only witness is the "victims" wife who has been allowed to call in at a police station of her choice at any time she likes and has not done so yet. i was read her account of what happened at the scene,in the interview room by the officer, and she said i hit him with closed fist initially but he stated i grabbed his throat. i did give him a pasing paul but after being struck andf after much provocation. any good mate? or still unsure? i was wondering about my side really in that im disabled and seeking treatment already which he knows about cos im not a fit and proper person bla bla bla. bless you all for reading this x
