I presume your husband pressed charges and it has / is going to court?
Question Author
yes it is going 2 court.i am really scared
Why are you scared?
sadly only a rap on the knuckles ,a small fine, or at most community service, be interesting to know if its his first offence.
Question Author
they are not a nice family and if there boy goes to prison there family will not be happy with us. i just want this 2 all go away
very unlikely anne that's the tabloid story.

I think from memory 5 years is about the starting for adult GBH jeuvenile about half of that

I think the chances of a non custodial sentence for GBH are really small
even for a first offence jake ?
What part did your husband play in the fight?
Question Author
he was on his way home from a night out when some kids said something 2 him, he mouthed back and then this guy came from behind and hit him. he fell 2 the floor and did not get back up. it was on the news and the guy admitted it
I'd find it hard to believe that the lad wouldn't get a sentence.

Are you in private housing? Can you not talk to the police about your fears?
Question Author
i am in private housing. i just phoned cid and my officer is on rest till tuesday so i will have 2 wait till then.
When is he in court?
Question Author
3rd of september
Well that gives you three days to talk to the police. Plus there's a chance it could get adjourned..
Guidelines here on GBH

http://www.cps.gov.uk...ily_harm_with_intent/

Cases with 17 year olds quoted involved stabbings and were generally of the 2-3 years basis - but one initially non-custodial but was overturned as unduely leniant on appeal by the CPS.

Difficult to say without further details but I think even if he got a non custodial sentence it would almost certainly be overturned on appeal.

Did he kick your husband in the head? that would be seen an an aggravating factor
Question Author
no he was not kicked in the head, thank god.... thank u for that information i will read up on it now :-)
