Daughter is manger of a day nursery, last week her deputy caught one of the other employees in the office after hours accessing porn on the computer, (the bloke works as a part time nursery nurse and also cleaner), which is why he was there after hours. Daughter checked the history on the computer the next day and let's just say the sites visited by him were unsavoury to say the least. She suspended him, he later sent a text saying he was resigning. Daughter has informed Ofsted and the local council.

The thing is he also has another job working with vulnerable adults, my daughter wants to inform his other employer about what has happened but has been told she is not allowed to do this. She is now worried about the vulnerable adults in his care and is constantly fretting about this. He was suspended by the nursery last year when allegations were made about sexual contact by one of the children, the police investigated and he was allowed to return to work, (she was not manager then).

Should she go against the advice not to inform his other employer or just keep her mouth shut, what are the legal implications if she does. Thank you.

Does the porn he was accessing suggest he might be a danger to vulnerable adults?

The porn mainly involved children.
If it was child porn the police should have been informed.
If it was 'adult porn' I'd let it go if it was 'underage' I'd contact the police before someone from the council comes and 'tidies up' asking to remain as anonymous as possible

I wouldn't have thought so it's her responsibility if she has informed Ofsted and the local council. Do they both know about his other job? If not then I would definitely inform them about that as well as there may be things to do with safeguarding vulnerable adults that would be applicable in this case. But otherwise if it's Ofsted or local council that have advised that she can not do this then I guess her hands are tied.

I suppose an annoymimus call could be made tipping them off but that's a really rather obvious thing to do if she's been told not to and could end up getting her in trouble. Plus, looking at porn doesn't necessarily make the fella a risk, just a bit stupid for doing it at work and getting caught!

The police are involved now, but he is still working in his other job, these are young adults with learning difficulties.
If it's child porn then Ofsted and local council should already have informed the police and it should already be being looked in to I believe.
If he's been accessing child porn why on earth has she not phoned the police?
She can tell the police about his other job, although I expect they are aware.

The police are involved.
It might affect the investigation if your daughter tells the other employer. The police are involved and investigating so are probably aware. I would not say anything.
i would agree that under child safety legislation it is her role/responsibilty ... and as she has reported matters she has fulfilled it!
if the police are informed they may already be monitoring his internet access at his other work place... fingers crossed he will slip up there too

Thanks people, I will get her to read this when she gets home.
have no idea what the law is on this but personally if I find it a bit weird that an adult would need/want to access porn on A) a works computer and B) especially when that work is looking after young children, If he can't wait until he's in the privacy of his own home to look then he has a problem and yes I would mention it, there is a time and a place and its definitely not in a workplace where there is young children or vulnerable adults! Or in a public library ;0)
Child nurseries and homes for young/older adults are registered with the Care Inspectorate and all staff who are under disciplinary should be reported to them and the SSSC. sHE HAS A RESPONSIBILITY TO REPORT THIS IMMEDIATELY
