My wife passed away nearly 10 years ago and under the terms of her pension scheme I will get half her pension with effect from May 2013.
Her pension scheme is wanting to know what pensions I am now being paid.
I have looked at the terms of my recent redundancy / pension agreement and it states that I am not allowed to disclose any details of my redundancy agreement or pension unless required to do so by law.
I have contacted my ex employers to try to get permission to give my pension figures to my wife's pension scheme to enable payment but it has been refused.
I have looked at the letters issued to me after my wife passed away and they mention no requirement to disclose my pension figures so I did not know anything about this at the time I signed my redundancy agreement.
Where do I go from here?. Could my ex employers take any action if I disclose the fgures to my wife's pension scheme?.
No harm in mentioning CAB- it's usuallly good advice in these cases. It's just that we keep going over the same ground, whether it be care home fees or obscure pensions scheme rules. But if people want to help that's clearly fine.
I would guess that your wife’s pension company wants to know the details of your other income so that they can deduct the tax due at source.
Although they could pay out the gross amount and leave you to pay the requisite tax via your annual tax return – I believe that HMRC could, if they so wished, chase the pension provider (for the due tax) in the event that you cannot pay the tax owing.
I cannot imagine that any pension scheme was cease paying someone a company pension simply because they had provided information on their pension earnings to another company.
