Finders Keepers?

As a favour we let a friend of our sons leave a kayak in our garden. At the beginning of july he was asked to move it, he was asked again a fortnight later and august when he agreed to remove it that weekend. He has been asked by f.b. text and friends and 2 weeks ago I sent a message via my son that if he did not move it by the 1st nov I would. It is still here, laying there taking part of my parking. Is it legally mine yet?

It's no good sending verbal messages, you need written evidence that you have given him an ultimatum - it's worth a few bob, IMO you can't just take it.

As you know the name and address of the person who is the owner of the goods serve on them a notice informing them of the date you intend to dispose of the goods (giving one month’s notice) and the location where the goods can be collected, stating if not collected you will treat the goods as abandoned property. I do not think you will then face action.
Many years ago my sister and I were sitting in an outdoor part of a cafe and a woman forgot her handbag. When the woman at the next table left she picked it up and took it away.
My sister, who used to be a police woman, said it was theft by finding. I don't know if it is still the same but other than small change dropped in the sofa at my house if you find something like that you should hand it in.
