I've been talking to this guy for three years am just recent started seeing him an he's now just told me that he wants to be with me but he might be getting charged with Statutory Rape an I'm getting my self all worried thinking I might see him again.

So my question is how long can you get for it and if someone could help me understand what Statutory Rape is?

I don't think that is correct, many handicapped people are able to give consent!!
After hearing him say that I am not surprised you are worried that you might actually see him again !
There is obviously some sort of issue with a previous sexual relationship/encounter that he has had.
Let the dust settle with that matter before you commit yourself to going any further with this man.

The thing is it complicated
He's 19 and when he was 13 he an this girl got up to things an she's only just is trying to get him done for rape an she did consent so I don't understand why she's doing it now he's been going through this for 2 years now
The only logic thing is both family's had an argument now this had happened I don't think it's right to do that

The 13 year old girl is deemed too young to consent to sex so it is classed as statutory rape.

He was 13 and she's was 10 but mentally he's was 8
is he in Britain? Statutory rape is a charge you hear more of in America.
Oh dear. The fact she was 10 makes it very much worse.

And yeah I know it does and yeah in the heads it's 5years younger then he is actual age
Has he got medical proof of that? Is he receiving any form of treatment, counselling or classed as special needs?

Yeah I do believe he does have proof and I'm not sure as he's quiet a close person and he never told me till the other day
It is impossible to answer your question about sentencing because many factors are taken in to account.
The police have a duty to investigate this claim and pass all the evidence to the CPS. The CPS have to decide if there is sufficient evidence to secure a conviction AND if it is in the public interest to take it to court.

Has he admitted that sexual penetration took place?

I assume he's has as he's been back and toward to court for two years but I'm not sure what the girl has said
What I don't understand is why a young woman of 17 wants a relationship with a boy with a mental age of 12.

I would advise you not to get involved with him. Be friends if you want to, but don't take it further than that.
2 years seems a long time to be going back and forward to court for the same offence.
