Hi folks it's while since I have been on AB and was hoping for a some advice I seem to remember Barmaid was a solicitor who may be able to give me some.
My son and his partner split up in September, they both agreed to share custody of their daughter A(although this was not done by court order).The week after Christmas his partner asked if she could have A back a day early and my son agreed.A was at my house at the time and when her mum came to collect her, i asked who had brought her through, she said her Dad was waiting down the street.It turned out it wasn't her her Dad but her new partner who she has only known a matter of weeks.My son wasn't happy with this and took A from her mum and came to see me all upset as he didn't want A going the car with someone she didn't know.His partner then rang the police!A very nice policewoman arrived and obviously said it was a matter they should be resolving themselves and given that it was one of my sons days she wasn't obliged to do anything.My son said he was quite willing to let A go to her mum as long as it wasn't with the new boyfriend.Later that day A went off quite happily with her Grandad.On Saturday my son received a letter from his partners solicitor which stated that his partner has said that my son can no longer see his daughter until they have been to mediation.I look after A while my son is at work she will be coming today, what I would like to know is would I be breaking any law if I tell his partner that A is going to be staying with her her Dad tonight as she always does and she cannot dictate to us when my son sees his daughter?Thanks in advance.

Mediation can be a good idea as the mediators can see all sides of the story. If it is at all possible avoid solicitors, they will do nothing but cost a lot of money. My daughter had a custody problem and the solicitor was charging £50 a letter just to say what we could have said ourselves. If this does go to the family court the only decision they are permitted to make is to do ' Whatever is in the best interest of the child' that principle overrides all others, there are no 'rights' other than the rights of the child .
