Argos Being Awkward About My Probs With Tv

My 50''HD Bush TV is not working.

I had a local (friend) tv engineer looked at it today, who said it could be the software, or another fault, or knackered, but it would need to go to a workshop.

Its about 2 years old, so when I just spoke to Argos Direst, they said as its out of guarantee, they cant do anything, but when I mentioned the EU law.......From the Guardian#
#The Sale of Goods Act offers protection against faulty goods even when the manufacturer's guarantee has run out. The act says goods must last a reasonable time - and that can be anything up to six years from the date of purchase. ##
He said I would have to have a letter from the tv engineer who looked at it, and it will be passed on to Bush etc.
This of course is going to take days, maybe more, which means I wont have a tv to watch.

Is there anything else I can do, by law to get a better speedier answer?

I can watch tv on my laptop, but prefer a TV.

I am Not a Legal Eagle so anything I say is open to correction.

Personally, I don't think you have a case against Argos because, unless you have an extended Guantee to a customary 12 months, you are now 'out-of-time'.
AB is sometimes really frustrating. It posted before I had finished typing my response to you.

I was about to say that the 6 years to which you have referred is the period of time you have to place a case before the Small Claims Court. If the item is over 6 months old it is for you to prove that it was faulty from the date of delivery.

Incidentally, the Sale of Goods Act has been replaced by the Consumer Rights Act :-

Sorry to give you bad news.

Hans.

Thanks Hans,

I was in fact good news, as your link, led me on to Which magazine, who take your details of your purchase, faults, when bought etc, then you fill in the Qs, and they tell you if, or not you have any rights to a refund, or a replacement, which they said I have.

Then they e-mail you back with a letter, in this case for Argos, stating the Consumer Rights Act, and I am entitled to a replacement, which you can send by e-mail, or letter.
Thanks again.
I am pleased at your feedback.

Is 'Which' providing you with a free service ?.

Cheers....Hans.
I had a problem with a TV from ARGOS, had it 18 months ..but they have a 5 year rule for large items which can reasonably expect to last for this long..I was offered refund or replacement..I got refund but was allowed to keep telly ..which I had repaired for peanuts..double win....gave it to mum and got another with refund...go to customer services at head office, they were very helpful
Question Author
Yes it was a free service Hans.

Hi Murraymints,
Can you tell me who you was in contact with, and a bit more, and what they said etc, if you dont mind.

I called their free number, spoke to customer service, told them I wasn't happy, about not being offered anything, then they put me through to another department, who said it was out of warranty.
it was head office somewhere down south will have a look...get report from TV engineer..they also refund that cost...and quote their own 5 year rule..straightforward , had a cheque within 10 days..will have a look see if I can find old paperwork..it was a Bush 50 inch too !! look back here
Question Author
Murraymints, sorry the number I called, said it was direct, was 03456040105, which was on an Argos sticker at the back of the TV.

The other one was 08005978548

try here TRT ...state you have proof of purchase a TV engineer's report and under their own 5 year rule you are seeking a replacement or refund... I had no problems at all, although like you local stores seem unaware of their own 5 year rule... incidentally what was the problem with telly ? mine would not swith on although power light lit..was catastrophic failure of the main board..
Question Author
Thanks so much for getting back murraymints.

My problem is exactly the same as yours was, wouldn't come on, although the little blue light was on, but mine comes on when it feels like, like last night, and tonight.
I was on the phone at 9pm tonight, when it just came on, on its own, which it hasn't been on all day, and up to now its still on.

I think I might have a problem with proof of purchase, as I paid cash, and up to now cant find the receipt.
Argos said, they wouldn't have me on their computer if I paid cash, so will have to search again, BUT, just realised, I got the model number & phone numbers etc, from an Argos sticker on the back, so that must be some proof, but will have to wait till tomorrow, as will need help, to see if there's a date on it.

Please look out for a new msg tomorrow Murray, to see any more news, and thanks again for getting back to me :-)

.

I think each individual telly has a number on that sticker doodah so hopefully they can trace when it was purchased..I always keep receipts in box for a good year or more with stuff like this in attic...I had bought on line so had bank statement and their direct records...also mention goodwill and that you are a long time customer
Question Author
Thanks Murray,

Did you contact by phone or e-mail?

Very strange!!! TV came on this morning, first try!!!!!!! :-)
There is a lesson to be learnt here.
Never buy BUSH Tv's again , or anything else electrical, sold under this 'Brand' name. Cheap to buy but unreliable.
Go for LG, Samsung, Panasonic or Sony.
Large Screen TV's are not too expensive these days
Question Author
We all learn as we go in life Rowan, thanks for the tip..

Murray, :-) have found the delivery receipt with the catalogue number, and date of purchase which was, November 2015, so its only about 18 months old.

The TV is still working up to now, strange.
Question Author
Sorry Murray, another Q.
I spoke to the tv engineer about a report on the tv, and he asked me would an e-mail do, or do they want a proper letter. What did you send?
Could I just point one thing out, trt....you won't find Bush products anywhere else - only Argos. Bush is now an Argos own-brand...the name is stuck on all sorts of (mainly cheap, lower quality) stuff made solely for Argos.
FWIW

I would try a look at Martin Lewis's moneysavingexpert website for info on legal/sales/EU type stuff.
trt..my first contact was by telephone..it was their own customer services manager , a lady, can't remember her name, told me about 5 year rule. I had a proper hard copy report from engineer.. in your covering letter you need to mention not fit for purpose under the appropriate sale of goods act, that will be on the stuff you got from CAB.. and also that you are requesting refund or replacement in keeping with their own 5 year rule...I had no problems whatsoever !!
Question Author
Thanks again Murray,

will get it started tomorrow with the tv chaps report & letter from me.

Will let you know how I get on.
Question Author
Thanks OG,

I am going to look on there today, to see if there is anything else which could be helpful.
