My husband has got to go to court but the police never charged him or arrest him.

Never arrested or charged !, what does the court summons say ?.
Why has he got to go?

my husband has been to the police station on a voluntarily basis for questioning but no arrest was made and neither no caution but got to go to magistrate's court
Yes they can, by way of a summons.
More information needed, has he been summoned as a witness? That is a possibility, you do not need to be charged or arrested for that. But you can be arrested if you do not go to the court on the correct day and time.

he went to the police station has a voluntarily basis asked if he was arrested said no and then half way through the interview said he was free to leave at any time and no they sent him a letter of something with charge on and got to go to magistrates court i dont understand
Kitten Your answer was not there when I posted.It does look as though he is being summoned as a witness. The visit to the police station would have been to establish if he has potential information as a witness.
Similar happened to me, I was at work when the police turned up and told me I had to go to court. Someone on trial had given my name as a witness. They took me in a police car with the blue lights flashing as the trial was being held up until I could get there.
He needs to see a solicitor imo.

Yes, you can now be charged through the post but I thought it was only for minor offences.
The letter with Charge on it is the charge sheet. He has been charged with an offence and he has to go to court. If you had said this at the beginning we would have got to the correct advice a lot faster

he hasn't been cautioned tho EDDIE? Surely the police have to caution you?
They would have advised him at the police station that a charge was being made and it would be posted to him . That is why they told him he was free to leave, but I don't suppose he told you that.

nailit, perhaps they can now put the caution in writing as part of the letter. Just a guess.
